Copyright and takedowns
Owners publish their own photos in the Garage Showroom. If you believe one of them, or anything else on WhichTrim, infringes your copyright, send a notice to our designated agent and we will remove it promptly.
Designated agent
Copyright Agent, WhichTrim
Email: info@whichtrim.com
Our agent’s full details are also listed in the U.S. Copyright Office’s DMCA designated agent directory.
What a notice needs
- Your physical or electronic signature.
- The work you say is infringed.
- The page or photo on WhichTrim, with its address (each garage and car page has one, starting whichtrim.com/g/).
- Your name, postal address, telephone number and email address.
- A statement that you believe in good faith the use is not authorised by the owner, its agent or the law.
- A statement, under penalty of perjury, that the notice is accurate and that you are the owner or authorised to act for the owner.
What happens next
We remove or disable the material, tell the garage’s owner, and forward them your notice. The owner may send a counter-notice.
Counter-notice
If your photo was removed and you believe it was a mistake or misidentification, send our agent: your signature; the photo that was removed and where it appeared; a statement under penalty of perjury that you believe in good faith it was removed by mistake or misidentification; your name, address and telephone number; and a statement that you consent to the jurisdiction of the federal district court for your address (or, outside the United States, any judicial district in which WhichTrim may be found) and will accept service from the person who sent the notice. Unless they tell us within 10 to 14 business days that they have filed a court action, the photo can be restored.
Repeat infringers
An account whose garage is the subject of three valid notices within twelve months loses the Showroom. See the Showroom terms.
Sending a notice that knowingly misrepresents infringement can make you liable for damages (17 U.S.C. § 512(f)).
